Mortheon
Terms of Use
Last updated
These Terms of Use (the "Terms") are an agreement between you and Rigelion, an independent game developer based in Baku, Azerbaijan ("we", "us", "our") about your use of Mortheon (the "Game"), including its updates, demos and pre-release versions. By installing or playing the Game, you agree to these Terms. If you don't agree, please don't use the Game.
1. Your licence to play
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play the Game for your own non-commercial entertainment, on computers you own or control. If you got the Game through a store or launcher (such as Steam or itch.io), that store's terms also apply, for example the Steam Subscriber Agreement.
The Game is licensed to you, not sold. We and our licensors keep all rights not expressly granted to you.
2. A game in development
Mortheon is in active development. Pre-release versions, demos and playtest builds may contain bugs, unfinished features or balance problems, and they may change significantly or be removed. Updates may make older save files or worlds incompatible. We recommend backing up your save files before updating.
3. Rules of use
You agree not to:
- copy, distribute, sell, rent or sublicense the Game or any part of it, except as these Terms or the law allow;
- decompile, reverse engineer or disassemble the Game's code, except where the law gives you a right to do so that cannot be excluded by contract, or as needed to make mods under section 4;
- remove or change any copyright, trademark or other notices in the Game;
- use the Game for anything unlawful.
4. Mods
Mortheon is built to be moddable: much of its content is defined in data files. You may create mods (changes to the Game's content files and additions of your own) and share them for free, as long as:
- your mod is free to download and use; please ask us first if you want to accept donations or charge for it;
- you don't include the Game itself, its executable code or large parts of its original art and audio files;
- your mod doesn't contain malware, illegal content or anything that infringes someone else's rights;
- you make clear that your mod is unofficial and not made or endorsed by Rigelion.
Mods are used at your own risk. We don't review or support third-party mods, they may stop working after an update, and we may ask for a mod to be taken down if it breaks these rules. You keep the rights to the original work in your mod, and you allow us to play and show it (for example in a stream or a feature) and to use any idea from it to improve the Game.
5. Videos, streams and screenshots
You're welcome to stream the Game and to make and share videos and screenshots of it, including monetized videos on platforms like YouTube and Twitch, as long as you don't present it as an official Rigelion product and don't simply repackage the Game's music or art on its own.
6. Feedback
If you send us feedback, bug reports, suggestions or ideas, you allow us to use them to improve the Game without owing you anything. You confirm that you have the right to share anything you send us.
7. Privacy
Our Privacy Policy explains how the Game handles information. It is part of these Terms.
8. Ownership
The Game, including its code, design, text, art, music, names and logos, belongs to Rigelion or its licensors and is protected by copyright, trademark and other laws.
9. Updates and ending your licence
We may release updates to fix problems, add or remove content or change features. We may stop offering or supporting the Game at any time.
You can stop using the Game at any time by uninstalling it. We may end your licence if you seriously or repeatedly break these Terms. Sections 4, 6, 8, 10, 11 and 12 continue to apply after your licence ends.
10. Disclaimer
The Game is provided "as is" and "as available". To the fullest extent the law allows, we don't make any promises that the Game will be uninterrupted, error-free or free of harmful components, or that it will meet your expectations. If you are a consumer, you keep all the rights that consumer law gives you, which these Terms do not limit.
11. Limitation of liability
To the fullest extent the law allows, Rigelion won't be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, save files, profits or goodwill, arising from your use of the Game or any mod. Our total liability to you for any claim about the Game is limited to the amount you paid for the Game.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.
Before starting a formal dispute, please contact us at support@rigelion.com so we can try to resolve it informally.
13. Changes to these Terms
We may update these Terms from time to time, and we'll change the date at the top of this page when we do. If you keep playing after the changes take effect, you accept the updated Terms.
